To be fair, the judges aren’t the final arbiters. They’re ruling on what the law currently says. Congress can change the laws if it doesn’t like the judges’ rulings.

Yes, the Supreme Court is there to prevent laws that contravene the Constitution, but otherwise we’ve still got what Jefferson wanted: a legislature that can make the law.
