It wasn't a correction, it was an elaboration ;-) No slam intended, sorry if taken that way - more of piling on.
The constitution is clear and equally clear the common practice is in direct conflict with the constitution as written. I'd content that many times the "public servants" are not held accountable for the very practical reason they are in fact executing policy as dictated to them - policy that is unconstitutional but common. This has been an incremental process of circumvention that has taken decades to reach the point where, practically, ignoring binding law is tolerated when "the end justifies the means". And that is not a good thing.
