TWO SCOTUS DECISIONS TODAY:

  • The first decision is in Muldrow v. City of St. Louis. Justice Kagan has the opinion for the court, holding that a person must show "some" harm in a Title VII employment discrimination claim based on a job transfer, but that it need not be "significant." Justice Kavanaugh concurs only in judgment and would go further, writing that no additional harm should need to be shown under Title VII’s plain wording beyond the transfer itself. Justices Alito and Thomas also concur only in the judgment, but because they do not agree with the court’s formulation of its test.

  • The final decision today is in McIntosh v. US. Justice Sotomayor has the opinion for the unanimous court, allowing for forfeiture at sentencing, instead of prior to sentencing as federal rules set out, subject to harmless-error review on appeal.
