In codifying how the Treaty principles are to be applied, the actual Treaty principles have been lost. Section 4A appears to “clarify” the Treaty principles almost out of existence in relation to what happens on public conservation land, its economic development and commercial exploitation, and even whether conservation land remains in public ownership. It does this by defining in law that the section 4 obligations are met by merely inviting and considering comments from iwi.
