The DRC referred the situation to the ICC in 2004 - this is ongoing. The DRC is still dealing with the refugee crisis after the Rwandan genocide. This is not a “safe” third country. Iowa is holding a man from Bolivia - I do not know his status, if he has been adjudicated for crimes (which would make hime deportable). However, even if he has been adjudicated in an actual court (not Immigratin Court) that does not mean the US doesn’t still have a responsiblity under international human rights treaties, international law, customary law and our binding international treaties. This has to stop.
