Arguing the suit is not legally sound, 35 former judges, appointed by presidents from both parties, have filed a federal challenge in Florida to Trump’s $1.776 billion slush fund. The retired jurists are asking US District Judge Kathleen Williams to reverse her decision from last week, when she dismissed the IRS lawsuit, brought against the IRS by the president, his son, and the Trump Organization.
They argue that since Trump was attempting to represent both the plaintiff as a private person and the defendant in his capacity as head of the executive branch, which oversees the IRS, this amounts to “a fraud on the court.”The former judges also denounce the settlement, saying it “was not, and never will be, legally justified,” as it requires the actual “existence of a legitimate litigation and not, as here, one that is collusive, feigned, or fraudulent.” The jurists allege that “the ‘settlement’ was ultimately a product of collusion and is itself a fraud on the Court.”
The judges argue that the federal government plaintiffs deceived the Court, as they never mentioned any settlement in their Notice, and instead, the Department of Justice publicly announced a “settlement” of Trump’s IRS suit shortly after Plaintiffs filed their dismissal. They are ultimately asking Judge Williams to determine whether she “was deceived” by the arranged settlement presented to the Court on Trump’s behalf, which was agreed to by all parties.
