The key issue here is not just who might get paid but whether the executive branch can use a settlement with itself to create a nearly $1.8B taxpayer-funded payout program without Congress.

Today’s order freezes the fund before the money starts moving.This matters because the judge stopped DOJ before the money went out the door. Once taxpayer dollars are paid out, it can be very hard to get them back.
