This release by DHS Noem is troubling for many reasons not just because it is illegal, but for transgender people regardless of citizenship, it poses the risk of being outed by ICE agents.

Some are just beginning their transition and have not updated Identification to match who they are. And obviously, if they are undocumented or even legally here this presents in of itself a clear and present danger.

CNN legal expert, Elie Honig stated, "That's wrong. It's illegal and it's unconstitutional to require people to show their citizenship papers without some other basis to make a stop," he said. "So let me be clear. In order to stop somebody, detain them, question them for immigration purposes, an officer has to have reasonable suspicion. Now, that's a fairly low bar. It's lower than the bar that a law enforcement agent would need to make a stop or questioning for criminal purposes, but it's still a bar. It's not nothing."

I will update this story as it is still developing and we do not know what the full ramifications will be especially since DHS is no longer required to provide information regarding transgender, non-gender conforming or Non-binary individuals that are detained.
