BREAKING: The U.S. Supreme Court will review whether bans on gender-affirming medical care for minors violate equal protection guarantees.

The court agreed to hear the appeal brought by the Biden administration in response to Tennessee’s law banning the care. They did not grant the petitions brought by the challengers to the Tennessee and Kentucky laws, which also raised parental rights due process claims, in addition to the equal protection claims. The Biden administration had intervened in the Tennessee case and the Justice Department asked the justices to take up the case just on the equal protection claims.

The court did not deny certiorari in the challengers’ petitions, however, so it appears to be holding them, potentially until the case granted on Monday is resolved.

Altogether, the court granted certiorari in seven cases this morning. The cases will be hear in the new term that begins in the fall.
