If someone has EB2 NIW approved, is chargeable to India, and has a 2019 priority date, do not answer the I-485 question from the I-140 approval date alone.
The clean split:
NIW approval answers one question:
"Was this EB-2 I-140 approved?"
It does not answer:
"Can I file I-485 this month?"
For July 2026, USCIS says employment-based applicants must use the Final Action Dates chart. The July 2026 Visa Bulletin lists EB-2 India as unavailable.
So a 2019 EB-2 India priority date is not enough for an I-485 filing under EB-2 in July 2026.
That is a legal timing question. Use counsel for status, travel, dependents, and filing-risk decisions.
The separate evidence question is:
"Should I keep building NIW evidence, test EB1A, or clean up the I-140 strategy?"
