Idaho Legislature: Ask Legislators to VOTE YES on H0404 - Chicken ownership (posted 03/15/25)

H0404 permits residential property owners to pasture chickens (genus Gallus) while allowing local regulations to ensure community standards. It promotes local food production, protects property rights, and addresses food security in urban areas. Excludes multifamily units and properties already governed by agricultural zoning and single-family residences on lots smaller than .25 acres. Does not override city, county or local ordinances.

H0404 provides essential food security in an era when public health authorities (USDA) are using unscientific biosecurity methods called “culling,” in which an entire flock is destroyed if even one bird tests positive for a disease such as bird flu. The resulting chicken and egg shortages – yes, the egg came first – have resulted in high prices and scarcity.

People must be able to exercise their natural rights (section 22-4501, Idaho Code) to raise their own food in good times and bad as long as they do not negatively affect nearby property owners.

Notes:

  • H0404 is a more limited version of two good bills currently in the Senate: S1026, S1063.

  • Bird flu is endemic in wild birds such as mallard ducks, which fly everywhere. No amount of killing domestic hens can possibly eradicate bird flu.

  • Effective, safe, low-cost disinfection methods could kill bird flu virus without killing birds, but large-scale operations are not using them. UV light, chlorine dioxide or misted hydrogen peroxide could potentially stop avian influenza spread.

  • Tests being run by USDA are of questionable accuracy and not being disclosed;

  • Large-scale chicken farmers (“Big Egg”) are being paid to kill their chickens inhumanely, then restock their flocks, raise prices, and repeat the process;

  • Killing an entire flock prevents hens that otherwise would survive from developing long-lasting immunity. Such immunity would build more resistant flocks and protect other chickens – and people – from bird flu.
