S1189 removes immunity for human gene therapy products distributed in Idaho, ensuring that manufacturers remain legally accountable for potential design defects.

S1189 is a MUST PASS bill to protect those receiving human gene therapy products for infectious disease indications in Idaho (for example, mRNA COVID-19 shots). Because gene therapy products may have both short-term and long-term unforeseen consequences, manufacturers must accept full legal responsibility for design defects in their products if they distribute them in Idaho.

For too long, federal law has shielded vaccine manufacturers from liability for design defects through the National Childhood Vaccine Injury Act (42 U.S.C. 300aa-1, et seq.). The government’s compensation system for vaccine injuries is so meager and difficult for vaccine injured and killed to use that most give up and instead suffer unimaginable physical, financial, psychological, and family harms for the rest of their lives. For COVID-19 Emergency Use Authorization (EUA) shots, the separately administered Countermeasures Injury Compensation Program (CICP) is even worse.

Legal and financial liability for harms is the ONLY way to incentivize gene therapy product manufacturers to make safe products; immunity from liability instead incentivizes manufacturers to maximize profits over people, with no regard for product quality or safety.

S1189 prioritizes the rights of Idaho citizens to seek redress for injuries caused by defective human gene therapy products. It also safeguards against unchecked proliferation of genetic medical interventions that have not been subjected to adequate long-term study.

By their very nature, gene therapy products for infectious diseases have manufacturing defects; they do not adhere to current Good Manufacturing Practices (cGMP).

We could provide thousands of studies, articles, and a litany of harms caused by the first mRNA gene therapy products for COVID-19 (many more are in the pipeline and at least one other, for RSV, is in use already). The paper includes countless scientific, peer-reviewed references and links to support the numbered statements below.

BOTTOM LINE: Idaho MUST NOT allow potentially design flawed, contaminated gene therapy products to be administered liability-free. Please pass S1189.
