Idaho Attorney General Raul Labrador, TX AG Ken Paxton, and more than a dozen other state attorneys general filed a lawsuit in the U.S. District Court in the Eastern District of Texas against the Biden-Harris Administration confronting their massive overreach with an immigration policy called “Parole in Place,” or PIP.

The Court immediately granted a temporary injunction, stopping the Administration’s overreach in its tracks. The Court agreed that the claims were “substantial” concerning the damage this policy scheme could present to the states.

Labrador explains that PIP was originally designed to allow some illegal immigrants to remain in the United States, specifically for “urgent humanitarian reasons or significant public benefit” while their application is being resolved (e.g., for a child with a serious illness who is receiving a hard-to-find treatment).

Courts have said clearly that the federal government “cannot use that power to parole aliens en masse.” But that's what the Biden/Harris administration has tried to do by claiming, “unfettered discretion,” which has led whole lot of abuse and overreach.

Federal law prohibits illegal aliens from obtaining most immigration benefits – work permits, identification, and a legal pathway to more permanent residency. But the Biden-Harris administration has repeatedly overstepped both the spirit and the letter of federal laws.

When a Court grants a temporary injunction based on the merits of the case as it did here, this indicates the plaintiff’s lawsuit is likely to prevail. We can only hope the final ruling to stay PIP is as good.
