Idaho Attorney General Raúl Labrador: Lava Ridge Wind Project Court Challenges (09/13/24)

The Lava Ridge massive wind turbine project continues to threaten Idaho as Bureau of Land Management (BLM) insists on shoving this unwanted project down the throats of objecting Idahoans in order to ship energy to California and enrich an East Coast consortium called Magic Valley Energy, LLC.

Idaho’s Attorney General describes two court challenges he has filed to fight this project:

  1. Petition of judicial review filing in the Ninth Circuit Court of Appeals. This action is based on the FAA’s inadequate review of low-level flight hazards. Thousands of economically crucial agricultural aviation flights occur yearly in the area, typically operating well below 500 feet. Even BLM’s own Environmental Impact Statement (EIS) expressly recognizes the importance of low-level aviation operations in the Project area.

  2. Federal district court for the District of Idaho filing related to the FAA’s incomplete response to our Freedom of Information Act (FOIA) request regarding the “hazard” evaluations. Missing were the communications between the FAA and Magic Valley Energy, public comments made about the project, and the individual hazard reviews for approximately 100 of the 500 proposed turbines.
