Idaho Legislature: Ask Legislators to VOTE YES on S1009 — Militia, prohibition, repeal (posted 01/23/25, updated 02/04/25)

US Constitution First Amendment:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

US Constitution Second Amendment:

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Senate Bill 1009 would repeal the unconstitutional, antiquated Section 46-802, Idaho Code that prohibits members of organizations other than the National Guard, unorganized militia, or selected other groups from associating and parading in public with firearms. The legislation supports the First and Second Amendment Rights afforded to Idahoans under the U. S. Constitution and Article 1 of the Idaho Constitution.

Currently Section 46-802, Idaho Code, violates the First and Second amendments to the U.S. Constitution and Article I, Sections 9, 10, and 11 of the Idaho Constitution. Simple and straightforward. The unconstitutional code must be repealed.
