Idaho Legislature: Ask legislators to VOTE YES on H0041 - Flags, public schools (posted 01/30/25)

This bill would ban third party political statement statement flags, which do not belong in the classroom. The bill helps ensure that the classroom is free from disruptive partisan politics that make students uncomfortable, unwelcome, or targets of bullying if they disagree with the consensus.

The bill adds a new section of Code – 33-143. DISPLAY OF FLAGS AND BANNERS ON PUBLIC SCHOOL PROPERTY:

Only the following would be allowed in any public elementary school or public secondary school:

  • The United States flag;

  • The official flag of the state of Idaho, or any county, municipality, public university or community college, school district, special district, or any other political subdivision or governmental instrumentality of or within the state;

  • Official flags of any state in the United States;

  • Official flags of recognized foreign nations with which the United States is not engaged in hostile action;

  • Official school flags;

  • Official flags of any of the military branches and units of the United States;

  • Official flags of Indian tribes;

  • Flags or banners recognized by the Idaho department of education that are awarded for achievements;

  • Flags or banners representing official school mascots and colors.

The bill also disallows flags or banners representing a political viewpoint, including but not limited to flags or banners regarding a political party, race, sexual orientation, gender, or a political ideology.

NOTE: We also support H0045, which specifies flags that government entities may fly. Of course, for clarity, we would prefer just a single flag bill that added a subsection specifically for public schools, since H0041 and H0045 are similar otherwise.
