Idaho Legislators: Ask Legislators to VOTE YES on H0086 - Electric vehicles, local preemption (posted 02/01/25)

NOTE: H0086 is a slightly modified version of H0018, which we also supported.

H0086 adds new section 39-4109B: ELECTRIC VEHICLE BUILDING PLAN REQUIREMENTS – PREEMPTION. The gist is that neither the state of Idaho nor any local government in Idaho shall require that an electric vehicle (EV) charging station, a designated EV parking space, an upgraded electrical conduit, or other infrastructure for the purpose of EV charging station installation be included in a building plan.

Just as local governments cannot require installation or maintenance of gasoline or diesel filling stations or parking spaces at facilities, local governments should not require this for EV charging stations or parking spaces.

Such requirements for EVs are part of the "woke green agenda," which has no business doing business in Idaho. If Oregon and California want to do it, that's their prerogative, and they've exercised it to the detriment of their taxpayers (see Oregon examples in Selected References).

In Idaho, however, we must let markets – not bureaucrats and politicians – decide when and where to add charging stations and parking spaces for EVs. Let private entities make such decisions at their level, where such decisions belong.
