Idaho Legislature: Ask Legislators to VOTE YES on S1039 - Immigration enforcement (posted 02/02/25, update 04/10/25)

S1039 “Idaho ICE Act” fulfills Idaho's commitment to support the Trump administration to identify, detain, and deport dangerous illegal aliens found in Idaho.
We MUST remove illegal aliens (“illegals” for short) who “threaten the safety or security of the American people,” particularly those involved in criminal cartels, foreign gangs, criminal organizations, and human trafficking and smuggling. S1039 is a must-pass for accomplishing these goals.
S1039 is well-written, thorough, and to the point. Key provisions:
Defines dangerous crimes and other terms and specifies penalties (and certain exemptions) for violations by dangerous illegals or those who aid and abet them.
Allows law enforcement to access federal resources, work with federal authorities, and arrest dangerous illegals. Aka “287g” section 287(g) of the federal illegal immigration reform and immigrant responsibility act of 1996, P.L. 104-208, or a similar federal program.
Prohibits sanctuaries in Idaho.
Makes unlawful the presence of dangerous illegals in Idaho.
Makes unlawful the transport of dangerous illegals to Idaho.
Requires Idaho authorities to:
Confine dangerous illegals and smugglers, once apprehended.
Cooperate with ICE for the deportation of the confined alien.
Requires law enforcement to cooperate with federal immigration detainers.
Imposes a 5-year sentencing enhancement upon illegals who commit dangerous crimes in Idaho.
Question: Do provisions of S1039 mesh with H0083 Immigration, illegal entry? Probably, but smart lawyers should decide.
Many argue that enforcing our immigration laws will be a hardship on farmers and ranchers.
This argument is specious, and similar to the arguments used in the Civil War era to support slavery (who will pick cotton)?
The net effect of illegal immigration is negative: Drugs, gangs, and human trafficking; potential voter fraud; assorted violent crimes and petty crimes; car accidents; sovereignty and rule of law trashed. Moreover, many illegals depend on citizen taxpayers for food, housing, and medical care.
Idaho must do all that it can to stop the flow of dangerous illegal aliens, apprehend them, and deport them. It’s just common sense!
