Idaho Legislature: Ask Legislators to VOTE YES on SCR104 – Nuremberg Code (posted 02/06/25)

Informed consent is based on the Nuremburg Code, which was developed after WWII to prevent its atrocities from being repeated in the future. Unfortunately, the Nuremberg Code—like informed consent—has been abandoned: “Never again,” has become “Again and again.”

The following is required to give informed consent:

  1. Disclosure: Provides information necessary to make an autonomous decision and to ensure the subject adequately understands the information provided.

  2. Capacity: Requires that the subject can both understand the information provided and form a reasonable judgment based on potential consequences of his/her decision.

  3. Voluntariness: Requires that the subject has the right to freely exercise his/her decision making without being subjected to external pressure such as coercion, manipulation, or undue influence.

Wrongly, all aspects of informed consent go out the window when a Public Health Emergency is declared and Emergency Use Authorization (EUA) is granted.

After the horrific research that preceded the COVID-19 pandemic and continues to this day, the Nuremberg Code and other principles mentioned in SCR104 must never again be abandoned or forgotten.

SCR104:

  1. Reaffirms Nuremberg Code as the foundation for ethical medical and scientific research, prioritizing protection of human rights, principles of voluntary consent, and preventing harm;

  2. Recognizes the WMA Declaration of Helsinki, the Belmont Report, and UNESCO's bioethics and human rights framework while reinforcing the Nuremberg Code’s core principles;

  3. Urges all Idaho medical, academic, and research institutions to strictly adhere to the Nuremberg Code and these complementary guidelines, ensuring that all research on human subjects meets the highest ethical standards;

  4. Commits to reviewing and strengthening state laws and policies to ensure Nuremberg Code compliance, particularly regarding informed consent, protecting vulnerable populations, and providing independent ethical oversight;

  5. Encourages medical professionals, researchers, and the public to learn the Nuremberg Code principles and to foster ethical responsibility and respect for human dignity;

  6. Sends SCR104 to Idaho medical institutions, research organizations, and other relevant entities to reaffirm Idaho’s commitment to ethical principles of the Nuremberg Code being central to all research and medical practices.
