"There is a unique constitutional status...between the United States and Indian tribes."
This is a really important argument from Cecillia Wang, the ACLU attorney arguing today in the Birthright Citizenship case at SCOTUS. The far right has been trying to make the false argument that adhering to the original intent of the framers when it comes to children born in the US would exclude Natives. This is because Native Americans were not covered under the 14th Amendment Citizenship Clause.
So to scare people into being against Birthright Citizenship, the Trump admin has pushed this narrative that if we follow precedent regarding Birthright Citizenship, then Natives would lose their citizenship. This is not true. Native citizenship is protected under the Indian Citizenship Act of 1924. Being Indigenous to this country is not the same as moving here or being forcibly brought here. The Trump admin is purposely conflating these differences to create disinformation about our rights.
