BREAKING: A three-judge panel of the U.S Court of Appeals for as the Fifth Circuit has issued an administrative stay in the Braidwood case, halting the nationwide effect of U.S. District Judge Reed O’Connor’s ruling that would effectively end many of the Affordable Care Act’s preventative care coverage requirements. The motions panel did not rule on the Justice Department’s motion for a partial stay pending appeal, ordering that that motion is “carried with the case,” meaning the decision whether to keep the nationwide scope of O’Connor’s ruling on hold during the full appeal will be left with the merits panel that will actually hear the appeal in Braidwood. (DOJ only asked for a partial stay, not even seeking a stay of the ruling as to its applicability to the named plaintiffs in the case.)
