Peter Navarro, the former Trump adviser who was convicted contempt of Congress and faces four months prison, asked Chief Justice John Roberts on Friday afternoon to hold off his prison sentence during while he appeals his conviction.

Navarro faces prison time in connection with his refusal to comply with a subpoena from the Jan. 6 committee. He currently is to report to prison next week.

Navarro’s Friday shadow docket request at the U.S. Supreme Court came a day after the U.S. Court of Appeals for the D.C. Circuit rejected a similar request and went to Roberts as the circuit justice for the D.C. Circuit.

Roberts requested a response from the federal government by 2 p.m. Monday.

The chief justice can decide the matter on his own, but most significant shadow docket matters are referred to the full court for a decision.
