NEWS: Not only did ex-Rep. George Santos (R-N.Y.) plead guilty in his criminal case on Monday, but he also lost his lawsuit against Jimmy Kimmel for absurd Cameos that he did and that Kimmel aired.
On the same day Santos was pleading guilty to wire fraud and identity theft charges in the Eastern District of New York, U.S. District Judge Denise Cote in the Southern District of New York issued her ruling in Santos’s copyright lawsuit against Kimmel, ABC, and the Walt Disney Company.
Jimmy Kimmel Live had solicited several videos under fake names shortly after Santos started hawking videos on Cameo, and then Kimmel aired a handful of them in a “Will Santos Say It?” segment.
That — including his presentation of the videos — was transformative and, ultimately, fair use, Cote, a 77-year-old Clinton appointee, ruled on Monday in rejecting Santos’s copyright infringement lawsuit.
In addition to accepting Kimmel’s fair use defense, Cote also rejected a handful of Santos’s other claims as well and dismissed the lawsuit.
On Tuesday, however, lawyers for Santos announced that he will be appealing Cote’s decision dismissing the lawsuit to the U.S. Court of Appeals for the Second Circuit.
