Florida is scheduled to execute Noran Cole on Thursday for the 1994 murder of a student, John Edwards.

Cole has Parkinson’s disease, and his lawyers have brought an as-applied challenge to the state’s lethal injection method of execution related to his disease.

As his lawyers argue in a request filed on Sunday at the U.S. Supreme Court, “Florida’s current lethal injection procedures are unconstitutional as specifically applied to Cole because executing Cole under those procedures will very likely cause him needless pain and suffering due to the unique symptoms that he experiences caused by his Parkinson’s disease.”

If this execution takes place, it would be Florida’s first execution in 2024. It would, however, be the 13th execution in the United States this year.
