If you go to sec.gov and read through Moderna's 10-K & 10-Q filings (as well as Pfizer's), you'll see the companies disclose to their shareholders in those documents that mRNA products are considered gene therapies. They say it right in their own written filings with the SEC as a way to brief their shareholders of a possible risk to their investment.
