"Brian Morrissey, the Treasury Department’s general counsel and most senior lawyer, resigned Monday — just hours after the Anti-Weaponization Fund was announced — in what sources described to the New York Times as a dramatic departure driven by disgust at the fund’s creation.
Morrissey had been confirmed by the Senate only seven months ago. He is a former clerk for Supreme Court Justice Clarence Thomas, a former partner at the prestigious law firm Sidley Austin, and a veteran of Trump’s first administration.
He is not a Democrat. He is not a Never Trumper. He is exactly the kind of conservative lawyer Trump brought back into government to give his administration legal credibility. He quit the same day the fund was announced.
Morrissey used his resignation letter to thank Trump and Treasury Secretary Scott Bessent for the chance to serve. He has not spoken publicly about why he left.
The departure is significant precisely because of who Morrissey is. The judge who oversaw Trump’s IRS lawsuit had already raised concerns about the conflict of interest inherent in a sitting president suing an agency he controls.
Outside lawyers the judge brought in to assess the case also raised concerns. The ethics groups that filed friend-of-the-court briefs called it a sham.
And now the Treasury’s own top lawyer — a Clarence Thomas clerk, a Trump loyalist, a man who came back to serve this administration — walked out the door the day the fund was unveiled.
He has not said why. He does not need to. The timing says everything."
