A VA solicitation for a boiler plant is too complex for a trades NAICS code, OHA ruled in reversing the agency’s NAICS designation. OHA ordered the VA to amend the NAICS code from 238220, which has a $19 million size standard, to 236220, with a $45 million size standard. The initial NAICS code is for plumbing, heating and air-conditioning contractors. But OHA found that the value of the contract is in construction, a function that “a contractor working in HVAC simply cannot do,” wrote Judge Christopher Holleman.
