A posting from an employment attorney regarding the Federal Resignation Offer from DOGE

My employment lawyer response to FAQs about the "deferred resignation" offer to federal employees. If you wish to leave your federal job, that is entirely up to you. BUT I am hearing a lot of misconceptions that this is a severance package in the conventional sense. However, aside, from guaranteeing telework for the remainder of your time, there are no other pay or benefits this comes with. So make sure you understand the following:

📒 It doesn't offer you any compensation or benefits if you accept it (yes, it may seem like it does at first glance, but there is no actual offer).

📒 From now till September 30, you are still a federal employee, which comes with all the restrictions on outside employment that come with your federal job. So no, you can't expect to take this offer and work another job from now till September 30.

📒 It doesn't offer that you will do little to no work between now and the September 30 resignation date, even though it may appear to do so at first glance. Nor can it: OPM can't just decide to pay people for the next ~10 months without working: that is not an authorized use of funds for federal employee salaries.

📒 It doesn't prevent the agency from firing you in the interim.

📒 It does guarantee that you will be exempt from the return to office mandate (so you can telework until September 30)

📒If you decide to take the offer, make sure you are sure. You don't have a right to rescind your resignation, and it is entirely up to the Agency if they will allow you back if you rescind.
